This session prepares investigators to ensure publicly sourced intelligence is legally admissible and defensible in court by focusing on evidentiary standards, documentation, and testimony. Participants gain a practical understanding of the Federal Rules of Evidence, with emphasis on hearsay rules and applicable exceptions for digital content, while learning how to authenticate OSINT and establish chain of custody. The course also addresses how to anticipate and defeat defense motions to exclude evidence, including challenges grounded in the Fourth Amendment to the United States Constitution, by building defensible collection methodologies and clearly articulating the reliability and provenance of OSINT in courtroom settings.
